Terms of Service

Agreement to these terms

These Terms of Service (“Terms”) are a contract between you and Duyna, operated by Duyna LLC (“Duyna,” “we,” “us”). By using Duyna, you agree to these Terms. If you do not agree, please do not use the service.

What Duyna is

Duyna lets you see the file the places you come back to keep on you. You log in with your phone number — we text you a one-time code, and there is no password. The service shows you the duynas the shops you visit hold for you, and lets each shop manage the record it keeps.

Who can use Duyna

You must be at least 13 years old (or the minimum age in your location) to use Duyna, and you must be able to form a binding contract. By using the service, you confirm that you meet these requirements.

Your phone number and access

You are responsible for the phone number and device you use to log in. Keep them secure — anyone with access to your number’s texts may be able to log in as you. Tell us promptly at support@duyna.app if you lose access to your number or suspect someone else has used it.

Shops, your duynas, and accuracy

The shops you visit are independent businesses, not Duyna. Each shop authors and controls the file it keeps on you; Duyna mirrors that record and provides the tools. We do not guarantee that what a shop records is accurate, complete, or current. Disputes about the contents of a duyna are between you and the shop that keeps it, though we will help where we reasonably can.

Acceptable use

When using Duyna, you agree not to:

• ·Use someone else's phone number or pretend to be another person.
• ·Attempt to access duynas, files, or data that are not yours.
• ·Interfere with, disrupt, or probe the service or its security.
• ·Use the service to break the law or infringe anyone's rights.
• ·Copy, scrape, or resell the service or its contents without permission.

Intellectual property

Duyna, its name, design, and software are owned by us and our licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable right to use the service as intended. The records shops keep remain associated with those shops; these Terms do not transfer ownership of that content to you or to us beyond what is needed to run the service.

The service is provided “as is”

To the fullest extent permitted by law, Duyna is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Duyna and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the prior twelve months, or one hundred US dollars ($100).

Changes to the service and these terms

We may change, suspend, or discontinue parts of the service, and we may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and give notice through the service. Continuing to use Duyna after a change means you accept the updated Terms.

Ending your use

You may stop using Duyna at any time. We may suspend or end your access if you violate these Terms or to protect the service and its users. Sections that by their nature should survive — such as intellectual property, disclaimers, and limitation of liability — will survive after your use ends.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in San Francisco, California, unless the law requires otherwise.
